The following Restrictive Covenants are hereby imposed upon all Lots in BURTON HOLLOW ESTATES SUBDIVISION NO. 4 of part of the Northwest ¼ of Section 16, Town 1 South, Range 9 East, according to the Plat thereof as recorded in Liber 85, on Pages 96 and 97, Wayne County Records, pursuant to City of Livonia Council Resolution No. 727-61 adopted on October 23, 1961:
- All Lots as shown on the Plat for the above captioned Subdivision shall be developed and used as and shall be the minimum building sites.
- Side yard and distances between buildings shall be at least the same as presently exists in Burton Hollow Estates Subdivision (as recorded in Liber 82 on Pages 25 and 26, Wayne County Records) and Burton Hollow Estates No. 2 (as recorded in Liber 84 on Pages 23, 24 and 25, Wayne County Records).
- In the event that subsequent to the date of this instrument the City of Livonia by Zoning Ordinance makes applicable to the lands covered by these Covenants less Restrictive Provisions than that set forth, then such less Restrictive Provisions shall apply in lieu hereof.
- The above property Restrictions shall continue and prevail and shall be enforceable, notwithstanding any subsequent Restrictive Covenants to the contrary or inconsistent herewith which may hereafter be imposed on the subject property above described. However, in particular cases of practical hardship or difficulty the above Covenants may be varied, modified or amended by Rouge Building Company, its successors and assigns, but only after approval by the City Council of the City of Livonia.
These Covenants shall run with the land and shall be binding on all parties and all persons claiming under them from and after the date of recording this Agreement. Enforcement of these Restrictions shall be by proceedings in law or in equity against any person or persons violating or attempting to violate any Covenants either to restrain violation or recover damages and may be brought by any person owning any Lots or Sites herein above described. Invalidation of any one of these Covenants by judgment or decree shall in no way affect any of the other provisions which shall remain in full force and effect.
